1. Introduction
Welcome to MyAviatorList ("we," "our," or "us"). MyAviatorList is a platform designed to connect aircraft owners and operators with contract pilots for private carriage services under Part 91 of the Federal Aviation Regulations.
By accessing or using the MyAviatorList website, mobile application, or any other services offered by MyAviatorList (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Services.
Please read these Terms carefully as they constitute a legally binding agreement between you and AME Foresight LLC, the owner and operator of MyAviatorList.
2. User Roles and Responsibilities
2.1 Aircraft Owners and Operators
Aircraft owners and operators using MyAviatorList understand and agree that:
- MyAviatorList is designed primarily for private, non-commercial operations under Part 91 of the Federal Aviation Regulations.
- You are solely responsible for verifying the qualifications, certificates, ratings, currency, medical certification, and experience of any pilot you choose to hire.
- You are responsible for ensuring that any pilot hired through MyAviatorList meets all regulatory requirements for the specific operation.
- You are responsible for ensuring proper insurance coverage for your operations.
- You will comply with all applicable laws and regulations, including but not limited to FAA regulations, when conducting flight operations.
- You are responsible for maintaining operational control of the aircraft at all times as defined by the FAA.
- You will provide accurate and complete information about your aircraft and flight requirements.
2.2 Contract Pilots
Contract pilots using MyAviatorList understand and agree that:
- You must possess valid and current pilot certificates, ratings, and medical certification required for any flight you accept.
- You must accurately represent your qualifications, experience, and currency on the platform.
- If you upload documents (e.g., pilot certificates, medical certificates, insurance documents), you represent and warrant that the documents are accurate, current, and belong to you.
- You acknowledge that uploading false or misleading documents constitutes a material breach of these Terms.
- All claims of certification, ratings, experience, or qualifications made by you on this platform are self-reported and not verified by MyAviatorList.
- You are responsible for ensuring that you meet all regulatory requirements for any flight you accept.
- You are responsible for obtaining appropriate insurance coverage for your services.
- You will comply with all applicable laws and regulations, including but not limited to FAA regulations, when conducting flight operations.
- You will maintain your proficiency and currency in accordance with FAA regulations.
- You will promptly notify aircraft owners/operators of any changes in your qualification status.
- You acknowledge that any misrepresentation of your qualifications or insurance coverage constitutes a material breach of these Terms.
3. Account Registration and Security
3.1 Account Creation
To use certain features of the Services, you may be required to create an account. When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
3.2 Account Security
You are responsible for safeguarding your password and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account or from your device. If you believe your account has been compromised, you must notify us immediately at [email protected].
3.3 Account Termination
We reserve the right to suspend or terminate your account at any time for any reason, including but not limited to:
- Violation of these Terms
- Providing false or misleading information
- Engaging in fraudulent or illegal activities
- Inactivity for an extended period

4. Disclaimer of Pilot Verification
MyAviatorList DOES NOT verify pilot credentials, certificates, ratings, currency, or experience. While we strive to maintain a high-quality community of contract pilots, we do not independently validate or certify any information provided by users of our platform. While we allow pilots to upload documentation, MyAviatorList does not verify or authenticate uploaded documents.
Aircraft owners and operators are solely responsible for:
- Verifying pilot certificates and ratings
- Confirming medical certification and currency
- Validating flight experience and qualifications
- Ensuring compliance with applicable flight operations requirements
- Conducting appropriate background and reference checks
- Verifying insurance coverage
- Verifying the authenticity and validity of any uploaded documents
We strongly recommend that aircraft owners and operators conduct thorough due diligence before engaging any pilot found through our platform.
5. Part 91 Operations Only
MyAviatorList is specifically designed for matching contract pilots with aircraft owners and operators conducting private operations under Part 91 of the Federal Aviation Regulations.
MyAviatorList IS NOT intended to facilitate:
- Commercial air carrier operations under Part 119/121
- On-demand air taxi or charter operations under Part 135
- Any operation where passengers or cargo are transported for compensation or hire
- Any operation that would require additional certification beyond Part 91
- "Flight sharing" or any arrangement where costs are split between pilot and passengers
- Any form of passenger transportation services offered to the general public
- Any arrangement where a non-owner/operator initiates flight requests
Users are solely responsible for ensuring their operations comply with all applicable regulations and requirements.
5.1 Operational Control
Aircraft owners/operators using MyAviatorList must maintain operational control of their aircraft at all times. The FAA defines operational control as "the exercise of authority over initiating, conducting, or terminating a flight." To comply with Part 91 operations:
- The aircraft owner/operator must maintain possession, command, and control of the aircraft
- The owner/operator must retain authority and responsibility for safety of flight operations
- The owner/operator must make all decisions regarding the acceptance of flights, aircraft dispatch, and flight operations
- The contract pilot is providing pilot services to the owner/operator, not transportation services to passengers
- The contract pilot does not determine when, where, or how the aircraft is operated
- The contract pilot may exercise PIC authority for flight safety while the owner/operator maintains operational control
Failure to maintain proper operational control may result in operations being classified as requiring Part 135 certification.
5.2 FAA Regulatory Compliance and "Holding Out"
Users understand and acknowledge that:
- The Federal Aviation Administration (FAA) may scrutinize flight operations that appear to constitute commercial operations
- Users are solely responsible for ensuring their flight operations do not constitute unlawful "holding out" or unauthorized commercial operations under FAA regulations
- MyAviatorList is designed exclusively for aircraft owner-initiated flights, where the owner retains operational control of the aircraft
- Pilots on this platform must NOT advertise transportation services to the general public, which could constitute "holding out"
- This platform is NOT to be used for booking passenger flights, arranging air charter services, or coordinating "flight sharing"
- Payment between users is strictly for pilot services, not for transportation
- The compensation of pilots for Part 91 operations must comply with all applicable regulations and interpretations
- MyAviatorList does not participate in flight operations, control negotiations between parties, or facilitate payments for flights
- MyAviatorList is analogous to a crew staffing agency or contract pilot directory, not a charter broker or travel agency
- In the event of an FAA investigation or audit, users are solely responsible for demonstrating the legality of their operations
- MyAviatorList accepts no liability for regulatory violations, fines, or penalties imposed on users
6. Flight Request and Pilot Selection Process
6.1 Flight Request System
MyAviatorList offers a flight request system where:
- Aircraft owners/operators can create flight requests specifying details including aircraft type, dates, departure/arrival locations, and offered day rate
- Pilots may express interest in a flight request
- Pilots may either accept the offered day rate or propose a different rate
- Aircraft owners/operators can review interested pilots and select a pilot for their flight
Users understand that expressing interest in a flight or accepting a pilot's interest does not constitute a binding agreement until both parties have confirmed the arrangement.
6.2 Day Rates
MyAviatorList allows aircraft owners/operators to specify offered day rates for flight requests and allows pilots to either accept these rates or propose alternatives. Users understand that:
- MyAviatorList does not set, control, or influence day rates
- MyAviatorList does not process payments between users
- All payment arrangements are made directly between aircraft owners/operators and pilots
- Users are responsible for complying with all applicable tax laws and regulations related to payments
6.3 Pilot Service Agreements
MyAviatorList strongly recommends that all parties enter into a written Pilot Service Agreement before any flight services are provided. While MyAviatorList provides a template agreement that users may choose to use, we do not require the use of this template.
The Pilot Service Agreement should address, at minimum:
- Scope of services to be provided
- Compensation and payment terms
- Insurance requirements
- Operational control and command authority
- Cancellation policies
- Liability limitations and indemnification
The Pilot Service Agreement should explicitly state that operational control remains with the aircraft owner/operator at all times and should not include any language that transfers operational control to the pilot. This is critical for maintaining compliance with Part 91 operations.
MyAviatorList is not a party to any agreement between aircraft owners/operators and contract pilots. We do not guarantee the performance of any party to such agreements.
6.4 Document Uploads
Contract pilots may upload documents to supplement their profile. These may include pilot certificates, resumes, medical certificates, and insurance documents. You agree that:
- You are solely responsible for the content and accuracy of any documents you upload.
- MyAviatorList does not independently verify uploaded documents and makes no warranties about their authenticity or completeness.
- Uploaded documents may be shared with other users (e.g., aircraft owners/operators) at your discretion or as part of responding to flight requests.
- You grant MyAviatorList a limited license to store, display, and transmit these documents as needed to operate the platform.
- MyAviatorList reserves the right to remove any uploaded documents that violate these Terms or applicable laws.
6.5 Aircraft Maintenance Logging
MyAviatorList offers an aircraft maintenance logging feature that allows aircraft owners and operators to track and manage maintenance records for their aircraft. Regarding this feature:
- Supplementary Tool Only: The maintenance logging system is provided as a supplementary tool for convenience and is NOT a replacement for official maintenance logbooks and records required by the FAA and other regulatory authorities.
- No Regulatory Compliance Guarantee: While designed to help users track maintenance events, MyAviatorList does not guarantee that use of this system satisfies any regulatory record-keeping requirements.
- User Responsibility: Users remain solely responsible for maintaining proper and compliant aircraft maintenance records as required by applicable regulations.
- No Verification: MyAviatorList does not verify the accuracy or completeness of any maintenance information entered by users.
- No Notifications or Reminders: While the system may calculate or display maintenance due dates, users should not rely solely on MyAviatorList for determining maintenance compliance or due dates.
- Data Security: Maintenance records are stored securely and are accessible only to the aircraft owner/operator and users they explicitly grant access to.
- Not for Resale Aircraft: Information recorded in the maintenance logging system should not be relied upon as the sole record for aircraft sales or valuations.
By using the maintenance logging feature, you acknowledge and agree that you will maintain separate, official maintenance records in accordance with FAA regulations and that the MyAviatorList system is used at your own risk as a secondary, unofficial logging system only.
6.6 AI-Powered Logbook Scanning
MyAviatorList offers AI-powered logbook scanning services for both aircraft maintenance logs and pilot flight records. By using these features, you understand and agree that:

- NOT A REPLACEMENT FOR REQUIRED RECORDKEEPING: Electronic copies and AI-extracted data do not, by themselves, guarantee compliance with FAA or other regulatory recordkeeping obligations. Digital records are provided for reference, convenience, review, and organization. You remain responsible for maintaining whatever records, signatures, originals, or retention practices are required for your specific operation, aircraft, and regulatory context.
- No FAA Approval: Our scanning and extraction services are not FAA-approved methods for maintaining official aircraft or pilot records.
- User Verification Required: All AI-extracted data must be verified by you before relying on it for any purpose.
AI Processing and Accuracy:
- Extraction Errors: AI extraction may contain errors, omissions, or inaccuracies. The AI may misinterpret handwritten text, dates, numbers, or maintenance terminology.
- No Warranty of Accuracy: MyAviatorList makes no warranty regarding the accuracy or completeness of AI-extracted data.
- User Responsibility: You are solely responsible for reviewing and correcting any extracted data before using it.
- Not Professional Advice: AI-generated summaries and extracted data do not constitute professional maintenance advice or airworthiness determinations.
Third-Party AI Services:
By uploading documents for AI processing, you consent to your data being processed by third-party services including:
- OpenAI (for document understanding, extraction, and summarization)
- Other service providers we may use to operate the Services (for example, secure file storage and OCR tooling)
Limitations of Liability:
- MyAviatorList is not liable for any errors in AI-extracted data
- We are not responsible for missed maintenance items, AD compliance issues, or any other consequences of relying on extracted data
- You agree to indemnify MyAviatorList for any claims arising from your use of AI-extracted data
Data Usage Rights:
- You retain ownership of your uploaded logbook images and documents
- You grant MyAviatorList a license to process, store, and display these documents as needed to provide the service
- Authorized MyAviatorList personnel and contractors may access your uploaded documents and extracted data only as needed to operate the Services, provide customer support, investigate abuse, and comply with legal obligations
- We may use aggregated and de-identified operational metrics (for example, error rates) to improve the Services; we do not sell your uploaded documents
- We do not use your uploaded documents to train general-purpose AI models without your permission
BY USING THE AI LOGBOOK SCANNING FEATURES, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THESE DISCLAIMERS AND AGREE TO USE THE SERVICE AT YOUR OWN RISK.
6.7 Shared Access Links and External Reference Checks
If you use the aircraft logbook sharing features or summary-generation features, you understand and agree that:
- Read-only share links: You may create share links that allow read-only access to selected aircraft records, logbook entries, documents, and summaries.
- No-login access: A recipient with a valid share link may be able to view the shared materials without creating or signing into an account.
- Link duration: Share links may expire on a date you select, may remain active until revoked, or may be set with no expiration if that option is offered in the product UI.
- Your responsibility: You are solely responsible for choosing the recipient, scope, and duration of any share link you create and for revoking access when it is no longer appropriate.
- Limited public-source research: When you generate certain aircraft summary reports, MyAviatorList may perform limited public-reference checks using aircraft identifiers or aircraft model information (for example, public accident-history or model-reference lookups) and include those results in the report. These public-source checks are supplementary only and may be incomplete or inaccurate.
7. Messaging System
MyAviatorList provides a messaging system to facilitate communication between platform users. By using this system, you agree that:
- Messages sent through the platform are intended for legitimate business communications related to flight services
- You will not use the messaging system for harassment, spam, solicitation, or illegal activities
- MyAviatorList may access and review message content to enforce these Terms, comply with legal obligations, or protect the rights, property, or safety of MyAviatorList, its users, or the public
- Messages may be stored on our servers and retained according to our Privacy Policy
- We may limit or disable messaging features for security, abuse prevention, and enforcement of these Terms
While we strive to protect your privacy, we cannot guarantee that communications between users will remain private. Users should exercise caution when sharing sensitive information.
8. Payments, One-Time Purchases, and Credits
8.1 Payments
MyAviatorList may offer paid features (including AI-powered logbook scanning and report generation). Payment processing is handled by our payment processor, Stripe. By making a purchase, you agree that:
- You will provide accurate and complete payment information
- You authorize Stripe to charge your selected payment method for the amount shown at checkout
- We may store limited payment-related information such as Stripe customer and transaction identifiers, purchase status, and receipts (we do not store full credit card numbers)
- We may refuse, cancel, or limit transactions to prevent fraud or abuse
8.2 Credits (Pages and Summaries)
Certain paid features may use a credits system. Credit quantities and pricing are shown at checkout and in the product UI.
- Page credits: Generally consumed when we process a logbook page using AI. Some pages (for example, blank pages detected by the system) may be skipped and not consume credits unless you choose to process them.
- Summary credits: Consumed when you generate a summary/report for an aircraft’s logbook.
- Account-level: Credits apply to your account and may be used across aircraft you add.
- No cash value: Credits are not legal tender, have no cash value, and are not transferable.
8.3 Refunds and Disputes
Except where required by law, purchases are non-refundable. If you believe you were charged in error, or if you have a billing dispute, please contact us at [email protected] before initiating a chargeback so we can try to resolve the issue.
9. Insurance Requirements and Accident Liability
MyAviatorList strongly recommends that:
- Aircraft owners and operators maintain appropriate hull and liability insurance for their aircraft and operations
- Contract pilots maintain appropriate professional liability insurance coverage
- All parties confirm insurance coverage requirements and verify coverage before any flight
- Insurance policies explicitly cover contract pilot arrangements
- Insurance certificates naming relevant parties as additional insureds be exchanged when appropriate
Users expressly acknowledge and agree that:
- MyAviatorList is solely a platform that connects aircraft owners/operators with contract pilots and is NOT a party to any flight operations
- MyAviatorList assumes NO responsibility or liability for any accidents, incidents, injuries, damages, or losses that may occur during flight operations arranged through the platform
- All risks associated with aviation activities are assumed entirely by the users involved in those activities
- Any dispute, claim, or controversy arising from flight operations is solely between the users involved and does not involve MyAviatorList
- Aviation is inherently risky, and users participate in flight operations at their own risk
The responsibility for ensuring appropriate insurance coverage and safe operations rests solely with the users of the platform.
10. Logbook Review and Summary Service
10.1 Service Description
MyAviatorList offers a logbook review and summary service that uses technology to digitize, organize, and extract information from aircraft logbooks. This service is designed as a supplementary tool to assist aircraft owners, prospective buyers, and A&P mechanics in reviewing maintenance records.
10.2 Important Disclaimers
THE LOGBOOK REVIEW SERVICE IS NOT A REPLACEMENT FOR PROFESSIONAL REVIEW BY A CERTIFIED A&P MECHANIC.
You understand and acknowledge that:
- The service uses automated technology to extract and organize logbook information
- Extracted data may contain errors, omissions, or inaccuracies
- The service cannot detect all maintenance issues or airworthiness concerns
- The service does not constitute a professional maintenance inspection
- The service does not verify the authenticity or completeness of logbook entries
- The service is intended to help organize information, not to certify airworthiness
- You remain solely responsible for verifying all maintenance information
- You should always have logbooks reviewed by a qualified A&P mechanic for critical decisions
- The service does not replace FAA-required inspections or certifications
10.3 No Professional Advice
The logbook review service does not provide professional aviation maintenance advice, airworthiness determinations, or regulatory compliance assessments. Any information provided is for organizational and reference purposes only.
10.4 User Responsibilities
When using the logbook review service, you agree to:
- Verify all extracted information against original logbook entries
- Have a qualified A&P mechanic review logbooks for pre-buy inspections
- Not rely solely on the service for airworthiness determinations
- Maintain original paper logbooks as required by FAA regulations
- Report any significant discrepancies you discover in extracted data
10.5 Limitation of Liability
MyAviatorList assumes no liability for:
- Errors or omissions in extracted logbook data
- Missed maintenance issues or airworthiness concerns
- Decisions made based on the service's output
- Any damages resulting from reliance on the service
10.6 Data Accuracy
While we strive for accuracy, the automated extraction process may:
- Misinterpret handwritten entries
- Incorrectly parse dates, times, or technical information
- Miss critical maintenance information
- Fail to identify all Airworthiness Directives or Service Bulletins
You acknowledge that the service is provided "as is" and that accuracy cannot be guaranteed.
11. User Conduct and Prohibited Activities
When using the Services, you agree not to:
- Violate any applicable law, regulation, or these Terms
- Provide false, inaccurate, or misleading information
- Impersonate or misrepresent your affiliation with any person or entity
- Upload documents that are false, misleading, fraudulent, or not associated with your personal qualifications
- Harass, abuse, or harm another person
- Send spam or other unsolicited messages
- Interfere with or disrupt the Services or servers or networks connected to the Services
- Attempt to gain unauthorized access to the Services or other users' accounts
- Use the Services for any illegal or unauthorized purpose
- Attempt to circumvent any technological measure implemented by MyAviatorList to protect the Services
- Advocate, encourage, or assist any third party in doing any of the foregoing
12. Intellectual Property
12.1 Ownership of Services
The Services, including all content, features, and functionality, are owned by MyAviatorList and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
12.2 Limited License
Subject to these Terms, MyAviatorList grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for your personal use or your internal business use in connection with lawful aircraft ownership, operation, maintenance, due diligence, staffing, and record organization.
12.3 Restrictions
You may not:
- Copy, modify, or create derivative works of the Services or any content therein
- Reproduce, distribute, publicly display, or publicly perform any content from the Services
- Remove any copyright, trademark, or other proprietary notices from the Services
- Use any data mining, robots, or similar data gathering or extraction methods
- Use the Services in any manner that could damage, disable, overburden, or impair the Services
12.4 User Content
You retain ownership of any content you submit to the Services (such as profile information, flight requests, messages, logbook pages, extracted entries, and edits). By submitting content, you grant MyAviatorList a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content in connection with providing the Services.
You represent and warrant that you have all rights and permissions necessary to submit the content and to grant the license above, and that your content does not violate any law or infringe any third-party rights (including privacy, publicity, and intellectual property rights).
13. Assumption of Risk and Disclaimer of Warranties
13.1 Assumption of Risk
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:
- AVIATION ACTIVITIES ARE INHERENTLY DANGEROUS AND INVOLVE SUBSTANTIAL RISKS, INCLUDING BUT NOT LIMITED TO THE RISK OF PROPERTY DAMAGE, SERIOUS BODILY INJURY, AND DEATH
- THESE RISKS MAY ARISE FROM NUMEROUS FACTORS, INCLUDING PILOT ERROR, AIRCRAFT MECHANICAL FAILURES, WEATHER CONDITIONS, AIR TRAFFIC CONTROL ERRORS, OR OTHER FACTORS BEYOND THE CONTROL OF MYAVIATORLIST OR ITS USERS
- BY USING THE SERVICES TO ARRANGE FLIGHT OPERATIONS, YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH SUCH AVIATION ACTIVITIES
- MYAVIATORLIST DOES NOT ASSESS OR GUARANTEE THE SAFETY OF ANY FLIGHT OPERATIONS, PILOTS, OR AIRCRAFT
- YOU ARE SOLELY RESPONSIBLE FOR ASSESSING AND ACCEPTING THE RISKS ASSOCIATED WITH ANY FLIGHT OPERATIONS ARRANGED THROUGH THE SERVICES
BY USING THE SERVICES, YOU EXPRESSLY AND VOLUNTARILY ACCEPT ALL RISKS RELATED TO AVIATION ACTIVITIES AND AGREE THAT MYAVIATORLIST SHALL NOT BE LIABLE FOR ANY RESULTING HARM.
13.2 Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MYAVIATORLIST DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
MYAVIATORLIST DOES NOT WARRANT THAT:
- THE SERVICES WILL MEET YOUR REQUIREMENTS
- THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
- THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE
- THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS
- ANY ERRORS IN THE SERVICES WILL BE CORRECTED
- PILOTS, AIRCRAFT OWNERS, OR OPERATORS USING THE SERVICES ARE QUALIFIED, CAPABLE, OR SAFE
- ANY FLIGHT OPERATIONS ARRANGED THROUGH THE SERVICES WILL BE CONDUCTED SAFELY OR IN COMPLIANCE WITH APPLICABLE LAWS AND REGULATIONS
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYAVIATORLIST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
- ANY CONTENT OBTAINED FROM THE SERVICES
- UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
- ANY TRANSACTION OR RELATIONSHIP BETWEEN USERS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES
- ANY AVIATION ACTIVITIES, FLIGHTS, OR OPERATIONS ARRANGED THROUGH THE SERVICES
- ANY ACCIDENTS, INCIDENTS, CRASHES, INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER HARM ARISING FROM OR RELATED TO FLIGHT OPERATIONS
- ANY ACTIONS, OMISSIONS, OR NEGLIGENCE OF PILOTS, AIRCRAFT OWNERS, OPERATORS, PASSENGERS, OR OTHER THIRD PARTIES
- ANY AIRCRAFT MALFUNCTIONS, MECHANICAL ISSUES, WEATHER CONDITIONS, OR OTHER AVIATION HAZARDS
MYAVIATORLIST EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY AVIATION ACTIVITIES. USERS PARTICIPATE IN FLIGHT OPERATIONS AT THEIR OWN RISK.
IN NO EVENT SHALL MYAVIATORLIST'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU HAVE PAID TO MYAVIATORLIST IN THE PAST TWELVE MONTHS, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
15. Indemnification
YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS MYAVIATORLIST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, OBLIGATIONS, LOSSES, LIABILITIES, COSTS OR DEBT, AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEY'S FEES) ARISING FROM:
- Your use of and access to the Services
- Your violation of any term of these Terms
- Your violation of any third-party right, including without limitation any copyright, property, or privacy right
- Any claim that content you submitted caused damage to a third party
- Any transaction or relationship between you and any other user of the Services
- Any flight operations arranged through the Services
- Any accidents, incidents, crashes, injuries, death, property damage, or other harm occurring during flight operations
- Any claims resulting from pilot error, negligence, or misconduct
- Any claims arising from the use of inaccurate, outdated, or fraudulent documentation uploaded by you
- Any claims relating to aircraft airworthiness, maintenance, or mechanical issues
- Any claims related to weather conditions, air traffic control, or other aviation factors
- Any regulatory violations or non-compliance with aviation laws or regulations
- Any failure to verify credentials, qualifications, or insurance coverage of pilots or aircraft
THIS INDEMNIFICATION SPECIFICALLY INCLUDES ANY CLAIMS ARISING FROM AVIATION ACTIVITIES ARRANGED THROUGH THE SERVICES, REGARDLESS OF CAUSE OR FAULT.
This defense and indemnification obligation will survive these Terms and your use of the Services.
16. Dispute Resolution
16.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
16.2 Arbitration
Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by arbitration in Delaware, using the English language in accordance with the Arbitration Rules and Procedures of the American Arbitration Association then in effect, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes.
16.3 Exceptions
Nothing in this section will prevent either party from seeking injunctive or other equitable relief from the courts for matters related to data security, intellectual property, or unauthorized access to the Services.
16.4 Class Action Waiver
ANY ARBITRATION UNDER THESE TERMS WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS AND CLASS ACTIONS ARE NOT PERMITTED. YOU UNDERSTAND THAT BY AGREEING TO THESE TERMS, YOU ARE WAIVING THE RIGHT TO PARTICIPATE IN CLASS ACTIONS.
16.5 Time Limitation
YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
17. Changes to Terms
MyAviatorList reserves the right to modify or replace these Terms at any time at our sole discretion. We will provide notice of any material changes by posting the updated Terms on our website or through other communications. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
We encourage you to review the Terms whenever you access the Services to stay informed about our rules and policies. If you do not agree to any new terms, you must stop using the Services.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.
19. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices published by MyAviatorList on the Services, shall constitute the entire agreement between you and MyAviatorList concerning the Services.
